By accessing or using the services in any manner, including, but not limited to, visiting or browsing our website at https://www.tijdigconsultants.com (the “Site”), our mobile applications (“Apps”), and any other websites, pages, features, or content owned and operated by TIJDIG Consultants that direct to these Terms of Use (collectively, the “Services”), you expressly understand, acknowledge, and agree to be bound by these Terms of Use. You are only authorized to use the Services if you agree to abide by all applicable laws and these Terms of Use.

By using our Services, you understand and agree that the collection and use of your personal information will be made in accordance with our Privacy Policy and these Terms of Use. TIJDIG Consultants Subscription

For the avoidance of doubt, these Terms of Use govern your access to and use of the Website, and do not govern the use of the Company-hosted data center monitoring service (the “Service”), which may only be accessed or used on a subscription basis pursuant to the applicable terms of service (which may vary depending on a number of factors, including whether or not the customer is an enterprise customer, operates as a managed service provider, or is purchasing the Service through a reseller) set forth in a written contract between the customer and TIJDIG Consultants.

Intellectual Property Rights

The Website and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by the Company, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These Terms of Use permit you to use the Website for your personal, non-commercial use and your consideration of Company’s products for use by your company only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Website, except as follows:

Governing Law and Jurisdiction

These Terms are governed by the laws of the Texas.

Waiver and Severability

No waiver by the Company of any term or condition set out in these Terms of Use shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of the Company to assert a right or provision under these Terms of Use shall not constitute a waiver of such right or provision.

If any provision of these Terms of Use is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Use will continue in full force and effect.

Entire Agreement

These Terms of Use, the Privacy Policy and the Recruiting Policy constitute the sole and entire agreement between you and TIJDIG Consultants regarding the Website and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Website.

Copyright Claims

We take allegations of copyright infringement seriously. If you believe that any User Content or other content on the Website infringes your copyright or other intellectual property rights, pursuant to Title 17, United States Code 512(c)(2) you may submit a notification in writing to our Designated Copyright Agent as described below. Upon receipt of notices complying with the Digital Millennium Copyright Act (“DMCA“), we will act to remove or disable access to infringing material or material found to be part of infringing activity.
